Sell It Fresh (Pty) Ltd ("we", "us", "our") is committed to protecting your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). This Privacy Policy explains how we collect, use, store, and protect information when you use the Sell It Fresh platform.

2. What Information We Collect
2.1 Information you provide
- Business name, registration number, and VAT number (if applicable).
- Contact details: name, email address, and phone number of authorised representatives.
- Farm location data (Growers): region and province. GPS coordinates are computed server-side only and never disclosed to Buyers.
- Delivery address information (Buyers).
- Bank account details (for payment processing via TradeSafe).
- Identity verification documents submitted as part of KYC.
- WhatsApp number (optional, for notification purposes).
2.2 Information generated through use
- Transaction history: listings, bids, contracts, and escrow events.
- Crop update photos and notes posted by Growers.
- Messages and communications within the Platform.
- Platform activity logs, device information, and IP addresses.
- Grower rating events and admin review records.
2.3 Information from third parties
We may receive information from TradeSafe (Pty) Ltd relating to KYC verification status and escrow transaction events. We do not receive your full banking credentials from TradeSafe.
3. How We Use Your Information
- To register and verify your account.
- To facilitate trading, contract formation, and escrow-backed settlement.
- To send transactional notifications (email and WhatsApp where opted in).
- To administer KYC verification and compliance obligations.
- To maintain Platform integrity, including fraud prevention and bypass detection.
- To compute Grower ratings and display reputation indicators to Buyers.
- To respond to queries, disputes, and support requests.
- To comply with applicable legal and regulatory obligations.
We do not use your personal information for unsolicited marketing without your consent.
4. Price Confidentiality
The Operator maintains strict price confidentiality between Growers and Buyers. Buyer gross prices are never disclosed to Growers. Grower net farmgate prices are never disclosed to Buyers. The Operator's commission is never shown to either party.
GPS coordinates of farms are computed server-side and are never transmitted to Buyers. Buyers see only a distance indicator and a region label.
5. Sharing of Information
We do not sell your personal information to third parties.
We share information only in the following circumstances:
- TradeSafe (Pty) Ltd: information required to create and manage your escrow account, including KYC documents and bank account details.
- Resend (email provider): email addresses and message content are processed by Resend for transactional email delivery only.
- Legal obligation: we may disclose information if required by law, court order, or a competent regulatory authority.
- Business transfer: in the event of a merger or acquisition, your information may transfer to the successor entity subject to equivalent privacy protections.
6. Data Storage and Security
Your data is stored on Supabase (PostgreSQL), a cloud database provider with servers located outside South Africa. By using the Platform, you consent to this cross-border transfer. We have implemented appropriate technical and organisational safeguards in accordance with POPIA.
Security measures include:
- Encryption of data in transit (TLS) and at rest.
- Role-based access controls limiting staff access to personal information.
- Audit logging of sensitive data access.
- Regular security reviews.
No method of electronic transmission or storage is 100% secure.
7. Retention of Information
We retain personal information for as long as your account is active and for 5 years after account closure, or longer if required by law.
Transaction records are retained for 7 years for accounting and audit purposes.
KYC documents are retained in accordance with applicable financial crime prevention legislation.
8. Your Rights Under POPIA
As a data subject under POPIA, you have the right to:
- Request access to the personal information we hold about you.
- Request correction of inaccurate or incomplete personal information.
- Request deletion of your personal information, subject to our retention obligations.
- Object to the processing of your personal information.
- Lodge a complaint with the Information Regulator of South Africa.

9. Cookies and Tracking
The Platform uses session cookies necessary for authentication and security. We do not use advertising cookies or third-party tracking pixels.
We may use anonymised analytics data to understand Platform usage patterns. This data does not identify individual users.
10. Children
The Platform is for business use only. We do not knowingly collect personal information from individuals under the age of 18.
11. Third-Party Links
The Platform may contain links to third-party websites including TradeSafe. We are not responsible for the privacy practices of those websites.
12. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated by email at least 14 days before they take effect.
